2. Use License

3. Suspension and Termination of service

atWar reserves the right to suspend or permanently terminate service if you violate atWar Terms and Conditions of Use and General Rules. No refund will be provided for Premium users.

4. Custom Maps ownership

Custom Maps and Scenarios and all associated media are and shall remain the sole and exclusive property of atWar. Without limiting the foregoing, you hereby assign to atWar all of your rights, title and interest in and to all Custom Maps, and agree that should atWar decide that it is necessary, you agree to execute future assignments promptly upon receiving such a request from atWar. Additionally, atWar shall have the right to keep the Custom Maps online even if their creator requests removal. In case of blocking users from playing your map, you agree to provide solid reasons for the block upon request.

5. Disclaimer

1. The materials are provided "as is". atWar makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, atWar does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

6. Limitations

In no event shall atWar or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on atWar's Internet site / online game, even if atWar or a atWar authorized representative has been notified orally or in writing of the possibility of such damage. 10. Governing Law

For any claim, cause of action, or dispute you have against us that arises out of or relates to atWar or these Terms, you agree that it will be resolved exclusively in the U.S. District Court for the Central District of California, or a state court located in Los Angeles County. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the State of California will govern these Terms and any claim, without regard to conflict of law provisions.

11. Severability

If any part of this agreement is declared unenforceable or invalid, all remaining clauses in this agreement shall remain binding on the customer.
